| 摘 要： | 全球化时代的到来给传统法律发展带来了新的契机,在全球化视角下,我们在注重法律趋同化、法律区域化和某些全球性法律的同时,更要注意到这种全新的视角可能提供的对传统法治精神进行反思的可能。传统法治为个人提供的救济途径较少,局限于国内视角并且过多地强调统治、规制而较少关注个人的自由、全面发展。上述问题的提出与解决对中国当下法律的发展具有重要的理论意义和现实意义。

| Abstract: | The coming of the globalization era brings the new opportunity for the traditional legal development.Under the globalization vision,we should not only focus on the integration,regionalization and globalization of law,but also pay attention to the possibility of the reflection on the traditional spirit of the rule of law.The traditional rule of law provides far too limited scope for personal relief channel and it is also limited within the domestic perspective.It overestimates the conception of ruling and regulation,at the same time pays too little attention to the free and overall development of individuals.All these arguments will contribute to the legal development both theoretically and practically. |
