| 摘 要： | 产权清晰是构成真正的合格的市场主体的首要条件,高校尤其是民办高校也不例外。根据产权理论,产权清晰有三层法律含义和四项构成要件。依此来衡量我国现行法律体系对民办高校产权的规范,至少有三个方面是不清晰的。对此本文提出了就从对教育公益性的认识,借鉴经济改革成功的经验和我国与WTO接轨等三个方面来思考民办高校产权清晰问题的思路。

| Abstract: | Property Right Distinction is the first premise of the main body of market, especially for Non-government Colleges and Universities. On the base of Property Right Theory, Property Right Distinction owes 3 different law meaning and 4 contents, showing at least 3 indistinct aspects. There are 3 feasible methods, including public welfare of education, the experiment of economy reforming and the entrance of World Trade Organization, for the Problem of non-government Colleges and Universities's Property Right Distinction. |
