| 摘 要： | 认定财产无主程序是我国民事诉讼法所确立的一种解决财产权属不明情况下归属问题的非讼程序，其对于恢复或者重构物权法律关系具有重要的意义。我国民事实体法对于权属不明财产的归属定位以及程序走向规定得过于笼统，甚至设置了其他程序来解决财产权属不明时归属定位的程序机制，导致作为具有相同程序价值的认定财产无主程序无法发挥其应有的功能。对于客观存在的多程序并存的局面，必须妥适处理认定财产无主与相关程序的衔接关系，通过综合考虑民事实体规则和程序规则蕴藏的法理来针对性地提出相应的解决方法，避免当事人在适用上的困扰与后续法律问题。
