| 摘 要： | 平行进口是国际贸易中一个不可回避的重要问题。一方面它涉及到知识产权所有人及其相对人利益的保护问题，另一方面它可能影响到一国的技术贸易战略能否得以顺利实施，从而影响到该国的经济发展。因此，如何在促进技术贸易的同时，又做好知识产权的保护；如何在我国的知识产权法的发展中，以TRIPS协议为目标和准则来指导我国平行进口问题的研究与立法，是我国成为世贸组织一员后迫切要做的一项重要工作。在此，从平行进口问题产生的理论根源、各国的立法比较及我国的立法对策等方面对平行进口的合法性问题进行探讨。

| Abstract: | Concurrent importation is inevitable in foreign trade. It affects not only the protection of the interest of the owner and the consumer,but also the practice of a nation's technical trade strategy and its economic development. Therefore,after China's WTO entry it is urgent to protect the intellectual property rights while it promotes its technical trade and to develop theories concerning legislation of intellection property rights on meeting the goal and criterion set by the TRIPS treaty to guide the study and legislation of concurrent importation in China. It discusses the theoretical origin and validity of concurrent importation on the basis of a comparison between legislations in different countries and China's response in its own correspondent tasks. |
