| 摘 要： | 传统刑事法把视角仅落在犯罪人身上，易忽略犯罪被害人的过错从而加重犯罪人的责任。然而，被害人也存在责任问题，认清被害人责任并在此基础上构建犯罪被害人责任制度，意义重大。这有利于回归社会正义、也有利于犯罪预防路径的开拓。

| Abstract: | The traditional criminal law only takes criminals into consideration, which easily leads to overlook the victim＇s responsibility and aggravate the criminal＇s . However, victims should also take the responsibility sometimes, so identifying it and constructing the responsibility system for victims have great significance. It will help to return to social justice, and carry out crime prevention. |
