| 摘 要： | 依据格式条款理论,分析CBA国内职业球员个人聘用合同格式条款的法律特征及成因、格式化性质和利弊等问题。从法理上讲,格式条款制定方中国篮协,在职业联赛中存在经济利益,有过分使用行政权利、规定不公正条款的可能,应当对格式条款进行必要的规制。

| Abstract: | By the theory of format clause,the legal characteristics,quality,the cause,the pros and cons of the format clauses in the domestic CBA professional player's individual employment contract were analyzed.To tell from legal principle,Chinese Basketball Association,who enacted the format clauses and got the financial gain from the professional league,has the motive to make the unfair clauses with its political administration;therefore,it is suggested to regulate the format clauses. |
