| 摘 要： | 从福建晋江一次村委选举纠纷入手，从不同角度分析了蕴含其中的法律问题，揭示了目前妨碍我国实行村民自治的一个相当重要的因素——乡镇政府的非法介入。然后在此基础上，剖析我国对村委会选举和村民自治予以司法救济的制度层面缺失，论述了构建村民自治司法救济制度的必要性，初步提出建立和完善村民自治司法救济制度的若干设想。

| Abstract: | Starting with a dispute concerning election of villagers' committee in Jinjiang,Fujian,the authors analyse from differ-ent angles the legal issue containing in this dispute;and reveal the illegal intervene of rural government as a quite important factorhampering the practice of villagers' autonomy in our country at present.On this basis,the authors dissect the deletion of the rem-forming the remedy judicature for villagers' autonomy in our country.As a preliminary step,the authors propose here several ten-tative plans concerning formulation and perfection of remedy Judicature for villagers' autonomy,hoping for attracting close attentionof the departments concerned. |
