| 摘 要： | 学习型社会就是"人人皆学、处处可学、时时能学"的社会,基本形成学习型社会将成为未来十年我国教育改革和发展规划的战略目标之一。为实现这一目标,以满足每个公民的基本学习需求,有必要将学习权保障确立为学习型社会教育法律与政策的价值基础。相对于教育中的公平、效率等价值取向,学习权保障是更为根本、更具有统摄力、更符合学习型社会本质的元价值,它能够最充分地体现学习是人的生存方式这一本体意义。为此,应力求做到:(1)克服现行教育法律与政策中的工具主义倾向,重视学习权的自赋性格,使其成为由宪法确认的公民基本权利;(2)明确学习是人的基本生活方式,针对学习的不同方式及其权利特性,构建有利于学习权实现的教育法律与政策制度;(3)遵循权利本位、机会均等、可选择性和弱势补偿等原则,最大限度地保障每个公民的学习权。

| Abstract: | A learning-oriented society is one in which "everyone should and can learn everywhere any time".To form such a society is one of the strategic goals in the next ten years.For this purpose,it is necessary to set up the value basis of education,law and policy of a learning society so as to satisfy the fundamental learning need of every citizen.Compared with the present systems that observe efficiency,equality,and freedom,my proposal may function to command and adjust the whole.It is also a breakthrough because it takes another step towards the essence of learning.It can further realize that learning has a noumenon meaning in one's way of living.However,some prerequisites are demanded for this purpose.First,the instrumentalist trend of learning must be stopped from the present education,law and policy,and attention should be provided for the given nature of learning law so as to make a basic civil right.Second,it should be made clear that learning is the basic way of living and that the relevant systems that facilitate the realization of learning right should be established according to different learning modes and peculiarities in a learning society.Third,principles such as right noumenon,opportunity equality,selectability and compensation for the weak must be observed to realize and protect a citizen's learning right to a maximal extent. |
