摘    要:承租人优先购买权是具有某些物权效力的债权,是一种既得权、请求权及专属于承租人的权利;其本质是对所有权的限制,以牺牲出卖人和第三人的合法利益为代价,换取对承租人特殊利益的保护。因此,司法实践中,既要充分保障权利人行使权利,又要严格掌握该项权利的行使条件,防止权利的滥用,做好各方利益间的平衡。

Abstract:The renter's priority to purchase is a kind of legal right which has some real right effects.It is also a kind of expecting power,claiming power and exclusivity in the right of the renter;Its essence is a kind of restriction to the ownership,with the price of sacrificing the seller and the third people's legal benefits,in order to protect the leasehold special benefits.Therefore in the fulfillment of jurisdiction,we should not only want to guarantee the leasehold exercising right well,and then want to control the exercise condition of the right strictly,preventing from the abuse of right,working well the balance of everyone's benefits.
