摘    要:我国现行调整房地产领域的法律法规规定,城镇国有土地所有权属于国家,地上物的所有权属于用地者,土地使用权期限届满,地上物的所有权由国家无偿取得。法律制度的此种设计模式在实践中产生了诸多弊端,理论上也存在难以阐明的障碍,实有修改之必要。为平衡保护土地所有权人与土地使用权人的权益,应借鉴大陆法系的地上权制度,规定土地所有权人欲取得地上的所有权,须以市价补偿为原则。

Abstract:The current laws and regulations concerning adjustment of real estate in China stipulate that the proprietary rights of state owned land in cities and towns belong to the state and those of superficies on the land belong to the user, and that with the expiration of using the land, the state can acquire the proprietary rights of superficies without consideration. However, in practice this designed pattern of laws and regulations generates a lot of disadvantages, and in terms of theory there are also some obstacles that unable to clarify. It is indeed necessary to revise them. To protect the interests of land owners and those of land users in a balanced way, the government should borrow ideas from the superficies institutions of continental law system, and stipulate that if the land owner intends to acquire the proprietary rights of superficies, he has to observe the principle of market compensation.
