| 摘 要： | 在数字时代背景下,职业体育数据兼具人格权和财产权属性,职业体育数据保护关乎运动员、赛事组织者、数据管理者等多主体的基本权益。但当前我国尚未制定职业体育数据保护方面的法律规范和行业规范,引发了现实中职业体育数据保护知情同意原则的失灵、数据自决权的虚置、财产性保护的阙如等问题。提出,应通过建立健全相应法律法规、制定行业规范等路径,以及通过集体谈判协议等形式实现私人救济,加强职业体育数据保护,助力我国职业体育发展。

| Abstract: | In the context of the digital age, professional sports data has the attributes of both personality rights and property rights. The protection of professional sports data is related to the basic rights and interests of athletes, event organizers, data managers and other subjects. However, at present, China has not yet formulated the legal norms and industry norms of professional sports data protection, which leads to the failure of the principle of informed consent in professional sports data protection, the absence of data self-determination and the lack of property protection. It is proposed that private relief should be realized through the establishment and improvement of corresponding laws and regulations, the formulation of industry norms, and the realization of collective bargaining agreements, so as to strengthen the protection of professional sports data and help the development of professional sports in China. |
