| 摘 要： | 本文认为通常情形下所说的预告登记的性质实际上是指的预告登记所保全请求权的法律性质。本文比较分析德国法上的相关规定和我国学者的诸多学说,认为应当将预告登记的法律性质定性为债权内容和物权效力的结合体,本质上仍为债权,仅仅是由于进行了登记而从立法技术上赋予了其某些物权性的效力。

| Abstract: | This paper comparatively analyzes the related provisions of German law and many theories of scholars in our country, considered that the legal nature of real estate advance notice registration should be a combination of right and debt content and real right potence, and still holds that it is in essence the creditor＇s rights due to some real right effectiveness, which potency endowed from register from some real right legislation technology. |
