| 摘 要： | 自单项体育协会实体化以来,体育行业自律实质上是作为体育社会团体法人的全国单项体育协会的内部自治.依据现行法律法规,全国单项体育协会属于具有独立法人资格的社会团体,理当依据自定<章程>实行行业协会自律,但该种治理模式在全国单项体育协会实际工作中并未得到切实体现.由于全国单项体育协会现行职能具备多重性:集政府职能管理、社会团体法人自律、企业经营活动于一体,因此其法律身份及其与其他市场主体的法律关系具有多样性和复杂性.通过从立法学层面考察全国单项体育协会的形成机制与路径、内部组织构成及其与国家体育行政部门的关系,阐明了现实中体育行业自律还存在立法缺陷及执法与守法困惑,以致体育行业并未取得实质性自律.对以上所述困境作出诠释并提出了立法建议.
