| 摘 要： | 近些年来，随着我国社会经济的发展、理念的更新，越来越多的行政主体青睐于采用行政承诺的方式来实施行政管理，提供各种服务。观察我国当下的社会，不难发现行政主体作出的承诺越来越多，涉及面也越来越广，承诺方式也更加多样。然而，行政承诺长期以来却缺少相应的责任规制，致使行政承诺的责任规制成为行政承诺运用过程中的一块“短板”。为弥补这一缺陷，有必要对行政承诺的概念、性质作出界定，理清行政承诺进行责任规制的现实原因和法理基础，并探寻适当的行政承诺责任规制方式。

| Abstract: | With the development of society and economy and the update of concepts, more and more administrative subjects in recent years are favor of adopting administrative commitment to implement the administrative management and provide services. At present, it is easy to find that more and more administrative commitments are made by administrative subjects, with the fields in- volved in the administrative commitments wider and wider, and the ways which the administrative commitments adopt are more and more diverse. However, our country is lack of the responsibility regulation of administrative commitment for a long time, which makes the responsibility regulation become a short board for administrative commitment system. To solve this problem, it is necessa- ry to define the concept and character of administrative commitment, to clarify the practical reasons and legal basis for the responsi- bility regulation of administrative commitment and to find the appropriate way for regulating the administrative commitment. |
