| 摘 要： | 摘要：许可是专利权利用的主要法律形式。专利权人放弃了部分独占地位，但获得了许可费收益；对于被许可方，以支付一定许可费为代价，获得了专利在一定领域的实施权。问题在于，被许可人是否有权对其专利实施权进行转让？我国现行法律对此并无规定，学界对此也存在诸多争议。本文着重分析专利许可实施权转让的合理性与必要性，并就其具体实施提出建议，希望对今后研究者有所启迪和帮助。

| Abstract: | License is the most important legal method in the usage of patent right. Patentee gives up the monopolization but obtains royalties. While licensee pays the license fee but obtains the right to implement the patent. The problem is that, if the licensee has the right to assign the usage right? The Chinese law does not regulate explicitly and the research on this problem is little. The reasonable and necessity of assigning the usage right are analyzed at some length, specific recommendations and measures for implementation are proposed. It might enlighten the comprehensive and thoroughly study on this issues. |
