| 摘 要： | 21世纪是知识经济的时代,科学技术影响着社会的各个方面。专家证据（司法鉴定）在诉讼活动中的应用越来越多,其所发挥的作用越来越大,有时甚至起着决定性的作用。但是,必须防止其滥用。美国的专家证据制度完备,极具代表性。美国专家证据＂可采性＂制度对我国司法实践有极强的可借鉴性。
