| 摘 要： | 司法裁判是行使国家审判权的法官,依法定程序对诉讼案件进行审理后,做出具有法律拘束力的结论性判定的活动。司法裁判受政治、社会和意识形态背景的影响,与此同时情感因素也是法官在断案过程中无法回避的问题,法官需要清醒的认识到这些因素,只有这样法官才能做出具有说服力的并且值得信赖的司法裁判。

| Abstract: | Judicial adjudication is the job of the judges who exercise national jurisdiction,and is the administration of legally binding determination of the conclusions after legal procedure on lawsuit cases.Judicial adjudication is under political,social and ideological background influences.Meanwhile,emotion is an avoidable factor for a judge to settle a lawsuit.Therefore,judges need a clear understanding of these factors,and only in this way,can they make more convincing and credible judicial adjudication. |
