| 摘 要： | 从表面上看,强制许可似乎与知识产权制度对其所有人自由交易的保护原则存在一定的冲突,但是,从深的层面来看,这却与知识产权制度追求社会公共利益的根本目的一致。本文介绍了强制许可的基本概念及其发生机理,并分别从国际法和各国国内法两个角度对之进行了比较性的研究。

| Abstract: | It seems apparently that compulsory license conflicts with the principle of protecting for the owner's free trade of IPR institution,however,it accords with the essential aim to seek for public profits.This paper firstly introduces the basic concept and mechanism of compulsory license,then give a comparative study from the dual perspectives of both international law and domestic law. |
