| 摘 要： | 清代司法实践中,对于发生在奸非案内的亲属杀伤行为,处置不同于一般的亲属杀伤行为,因奸而杀伤亲属,即便是卑亲属,处罚也极重;若因拒奸或捉奸杀伤亲属,即便是尊亲属,也从轻处罚,甚至可以免责。说明比起亲属间的杀伤,法律更重视奸非问题,从中也折射出古代社会亲属之间严格的性禁忌观念。

| Abstract: | The punishment on the conducts of kill and wound among renlatives in jianfei（adultery） cases was different from that in the general cases in the judicial practice of the qing dynasty.If the conducts of kill and wound caused by adultery,the punishment was very hevy,eventhough the murdered or wounded was lowly relative;If the conducts of kill and wound caused by refusing to be raped or catching adultery,the punishment was very light or get off punishment,evenzhough the the murdered or wounded was senior relative;It showed that the laws of the qing dynasty took the Jianfei（adultery） more seriously than the conducts of kill and wound among renlatives.It also reflected out that the strict notion of sex taboo existed among renlatives in ancient society. |
