| 摘 要： | 从有效专利、有效发明专利、有效专利布局、专利维持年限的角度，客观分析我国的专利现状，发现虽然中国技术创新活跃、专利数量庞大，但在技术含量、市场价值、核心技术的掌控等方面都存在很多问题。创新能力差、行政激励过度、宣传不到位和公众专利意识低下是导致专利制度没能充分发挥作用的主要原因，并针对问题给出改进建议，以利于专利真正回归到鼓励创新和技术进步、推动社会发展的本质上来。

| Abstract: | The paper analyzes present situation of patents in China from the view of effective patent,effectively inventive patent,effective patent layout and patent live life.The study finds that while China’s technology innovation is active and there are a large number of patents,there are many aspects of the problems on technical content,market value and controlling of core technology.Poor innovation,excessive administrative incentive,bad publicity and low public awareness of the patent are the main reasons causing the patent system failed to bring into full play.The paper gives suggestions to improve these problems,in order to facilitate patent to return to the essence which are not only to encourage innovation and technological progress but also to promote social development. |
