| 摘 要： | 《物权法》首次确立的预告登记制度,预告登记是指确保将来的债权能够实现,保障将来取得物权等目的,按照约定向登记机构申请办理预先登记。文章认为,预告登记与预售登记并不相同,预告登记依双方当事人的约定,将所保全的债权请求权登记于登记簿上,以产生物权排他效力。同时预告登记具有权利保全,顺位保全以及破产保全三大效力。其效力具有暂时性、附随性以及保障物权请求权的实现的特征。由于本登记、权利人怠于行使权利以及债权消灭等原因,预告登记的效力将终止。
