继承与拓新:韩非论德治与法治--兼与先秦儒家、道家比较

摘    要:文章将德分为八个子目,即仁、义、礼、智、忠、孝、廉、信,通过分别比较韩非同儒家、道家对法与它们的关系的探讨,认为韩非只是在一般的意义上反对“德治”,而对德的子概念用法加以约束,凡有悖于法的都加以批判,有利于法的都加以吸收拓展。这种对德治的审慎的做法,其实是对儒家、道家德治思想的继承与拓新,与当今社会主张德冶与法治相辅相成的观念暗合。

Inheritance and Renovation:Han Fei's View on the Relationship between Rule by Morality and Rule by Law

Abstract:It is opined in this paper that conventional morality consists of eight aspects: ren, yi, li, zhi, zhong, xiao, lian and xin. By comparison, it is obvious that Han Fei objectod to the rule by morality in general, but he realized that sometimes the morality of Confucianism and Taoism can help facilitate the rule by law. Thus he requested that law should control morality. Such a view is the inheritance and renovation of Confucianism and Taoism on rule by morality and complies with the current idea that rule by morality and rule by law complement with each other.
