| 摘 要： | 规制概念的界定与辨析对规制理论的深入探讨具有重要意义.认为,规制是指行政机构(或相对独立的规制机构)为克服市场失灵,实现社会福利的最大化,利用国家强制权,依据有关法律或法规,对微观经济主体的行为进行直接的经济、社会干预.规制与宏观调控、规制与反垄断既有区别,又有联系,都是政府治理市场失灵的重要手段.
