| 摘 要： | 酷刑严重侵犯人权，是国际社会公认的严重犯罪之一。现今世界上许多国家和地区，还存在着轻重程度不同的酷刑行为和现象，随着人权保障的国际化，反酷刑日益成为国际社会关注的重要内容。推进社会主义民主政治，保障罪犯的人权是一项重要的内容。完善反酷刑的法律规制，需要在考察酷刑犯罪的一般规律的基础上，结合国际反酷刑条约和国内立法作全局性的分析。

| Abstract: | The excruciation intringes upon human rights seriously,is one of generally recognized serious offenses in international society. There are excruciation behaviors and phenomenon in varying degrees in many countries and areas. With the internationalization of hmnan rights protection, the anti- ex- cmciation increasingly becomes the important contents paid attention to by international society. Promoting socialist democracy politics and safeguarding human rights of criminals is an important content. Improving the rules of anti-excruciation should be on the basis of the investigation of the general law of offenders, and combine international anti- excruciation treaties and internal legislation. |
