| 摘 要： | 贿赂外国公职人员或国际公共组织官员罪是《联合国反腐败公约》规定的一类新型犯罪。对这一犯罪,可以从贿赂对象、贿赂范围、贿赂方式等方面加以理解。但是,我国现行刑法中却没有关于贿赂外国公职人员或者国际公共组织官员犯罪的规定,这不合国际商务反腐的潮流。从现行刑法与国际公约的协调与接轨方式看,有必要将贿赂外国公职人员或国际公共组织官员罪纳入我国刑法范畴。同时,我国刑法在规定这一犯罪时,应注意刑法与《公约》的协调。

| Abstract: | The crime of bribing foreign civil servants or the international public organization officials constitutes a new type of crime in the UN Anti-Corruption Convention.For this crime,we can make a comprehension on the bribe objects,scales and ways.However,the existing Criminal Law does not prescribe the crime of bribing foreign civil servants or the international public organization officials,which is not compatible with the international trend.In terms of the coordination and incorporation of the existing Criminal Law and international convention,it is necessary to make the crime of bribing foreign civil servants or the international public organization officials enshrined in our Criminal Law.In addition,on the legislation of this crime,great attention should be made in the coordination between our Criminal Law and the international convention. |
