| 摘 要： | 共同过失犯罪能否构成共同犯罪,理论上尚存争议。然而,从共同犯罪成立的主客观相统一的构成条件来分析,共同过失犯罪显然符合这种条件。尽管共同过失犯罪存在多种学说,但实际上它与共同故意犯罪的构成条件是一致的,因此,共同过失犯罪同样是共同犯罪的形态之一。

| Abstract: | It remains disputable whether the offenses of joint negligence constitute joint negligence in theory.However,analyzed from constituting conditions of joint negligence established of unification of subjectivity and objectivity,obviously,the offense of joint negligence conforms to this conditions.Though the offense of joint negligence exists a variety of theories,in fact,the offense of joint negligence and joint negligence are in agreement with Constituting Conditions.Therefore,the offense of joint negligence is a form of joint negligence. |
