| 摘 要： | 本文阐述了我国刑事非法言词证据排除的概况,指出了目前存在的问题。从中国传统法律思想文化、体制、政治、经济等方面分析了形成当今现状的原因,论述了完善我国刑事非法言词证据排除规则的必要性,最后提出了我国刑事非法言词证据排除规则的立法构想。

| Abstract: | The article expatiates on the general of the excluding rule for criminal illegal testimonial evidence in China,and points out the problems existing at present.Based on the culture,system,politics and economy of Chinese traditional law thought,the article first analyses the reasons of the status quo nowadays,then dissertates the necessary for the perfecting of the excluding rule for criminal illegal testimonial evidence in China.At last,it brings forward some thoughts for the legislation of the excluding rule for criminal illegal testimonial evidence in China. |
