| 摘 要： | 公平竞争是运动员的重要权利,是运动员其他权利存在的前提,具体包括权利、竞争机会、竞争规则和竞争结果的公平。公平竞争之于运动员,是道德与法律的双重准则,是运动员的道德和法律权利,在法律上的支撑,主要有宪法、体育法、体育行政法规和体育政策等。但该权利在实现中却出现了一些侵权现象,如虚假行为、受贿行为、侵犯行为、赌博行为、破坏行为等。侵权行为的要件主要包括四个:侵犯运动员公平竞争权的主体、所侵犯的利益、侵犯公平竞争的行为和该行为引起的侵害结果、侵权人主观上的过错。加强公平竞争权的实现要从观念、立法、执法、监督和道德建设等方面入手。
