| 摘 要： | 我国的《工伤保险条例》对于及时救治和补偿受伤职工,保障工伤职工的合法权益,分散用人单位的工伤风险,发挥了重要作用。但在制度设计上还存在一些缺陷,导致劳动者的利益受损。应从根源上反思我国工伤保险体系的强制性特征,并借鉴美国的工伤认定理念和判例完善我国的工伤保险体系。

| Abstract: | Work Injury Insurance Regulation of our country play important roles in the following aspects as curing and compensating injured workers timely,guaranteeing legal rights of injured workers,and sharing work injury risk of employing units,etc.However,there are still some defects in system design which results in the damage of laborer's benefits.The mandatory features of our country's injury insurance system should be reflected from origin and the idea of injury confirmation of the United States should be used... |
