| 摘 要： | 国际人权公约所确立的普遍人权的多数内容在我国的法律中都能找到相应的内容，但我国的人权立法由于不同的文化背景等因素与国际人权公约也存在较大的差异。我国的人权立法可从以下方面丰富完善：1．从人权种类上丰富；2从人权内涵上丰富；3．从国际人权的国内法适用上丰富；4从国际人权的国内法救济上丰富。

| Abstract: | It is not difficult to find out the similar contents in Chinese law with the most parts of popular human rights set by international human rights treaty. But there are great differences between Chinese human rights legislation and international human rights treaty due to various cultural background and other reasons. Chinese human rights legislation can be perfect from below ： 1. To enrich the sorts of human rights. 2. To enrich the connotation of human rights, 3. To enrich the proper usage of national law from the international human rights. 4. To enrich national relieve law from the international human rights. |
