| 摘 要： | 文章解决了一个问题,即人格权是一种私法上的权利还是公法上的权利。这看似简单的问题,但事实上对人格权性质的判断涉及到了即将出台的民法典如何安排人格权的问题。因为只有把一种权利的性质确定清楚,才可以合理科学地把它安置到整个民法的宏观权利体系之中,以完备民法典。
