| 摘 要： | 自由主义是违宪审查制度的思想根源，而民主则存在着堕落为群氓政治的危险。民主并不适用于经济领域，应当被严格限制在政治领域。在自由与民主之间必须保持张力，并使民主定位于自由主义，从而转化为宪政民主。这样，民主为违宪审查提供合法性基础，违宪审查确保民主的良性运行。

| Abstract: | Liberalism is the thought source of the constitutional review system, but democracy exists the danger of degenerating into riffraff politics. Democracy is not appropriate for the economic domain, and should be strictly restricted within the political domain. The tension must be maintained between liberty and democracy, and democracy should be orientated towards liberalism, then transforms into constitutional democracy. In this way, democracy provides constitutional review with legal foundation, and constitutional review insures perfect function of democracy. |
