| 摘 要： | 公共服务市场化并不意味着行政权从这些领域退出，而是被分包给了经营者，并在服务契约中得以体现。因此，行政执法监督体系应当覆盖到这种被契约化行政权。鉴于目前的监督体制和机制难以适应公共服务市场化的要求，必须建构新的监督体制，实现对契约化的行政权力的监督，并对行政相对人提供及时的救济。
