| 摘 要： | 目前,我国高校贷款危机已成"既定事实",伴随着高校的债务危机和生源危机时代的到来,很多大学已经到了破产的边缘,设立大学破产制度有其现实的必要性。在国外,大学破产是件非常正常的事情,但我们很多人无法接受我国公立大学破产的原因就在于,不能正确的理解破产的含义、价值及其法律规则。事实上,大学破产并不是宣判"死刑",而是通过破产程序,让大学甩掉包袱,轻装上阵,实现再生。其中的关键制度设计,就在于大学重整及重整计划的履行。另外,建立大学债务预警机制、完善相关监督体制、修改相关法律是解决大学债务的根本之策。

| Abstract: | Now,the fact is the universities have loan crisis,and loan crisis not easy to recruit in universities,many universities have to fact the bankruptcy,so it need set up bankruptcy system.In abroad,it normal to set up bankruptcy system,but can not accept in china.Because we can not understand implication、value、law regulation of bankruptcy system.In fact,universities bankruptcy do not adjudicate death penalty,it through bankruptcy procedure help universities throw off the burden and develop.The key to procedure design is integration and carry out the plan in universities.And important to resolve debt is set up prepare system and perfect surveillance system and recompose bankruptcy law. |
