| 摘 要： | 受贿罪严重侵犯了国家公务活动的廉洁性。坚决彻底地打击受贿犯罪，促进党风廉政建设和维护社会稳定，是国家一贯坚持的刑事政策和治国方略。当前，法学理论界和实务界对受贿罪的“直接故意”、“职务便利”、“为他人谋取利益”以及受贿与接受正当馈赠的法律界限等构成要件产生了一些分歧。鉴于受贿罪具有重大的理论、实践和政治意义，有必要对受贿罪构成要件相关问题进行深入的研究。

| Abstract: | Bribery crimes do serious harm to the integrity of the national public service activities. It has been the criminal policy and the strategy of country governing to attack bribery crimes resolutely and thoroughly to promote the Party＇ s clean administration and to maintain social stability. However, there are some discrepancies in the law theory and practice circle on the constitutive dements of ＂direct intent＂, ＂taking advantage of position＂ and ＂for the benefit of others＂ and the boundaries between bribery and legitimate gifts. Hence, it is necessary to do further researches on the consitutive elements of bribery crimes. |
