| 摘 要： | 在日常生活中,关于共同危险行为的案件时有发生。由于共同危险行为具有较强的实践意义,因此学术界和实务界都对其颇为关注。学者们在研究该制度时,对于其构成要件问题存在许多不同的观点。随着《侵权责任法》的颁布,该法第10条专门对共同危险行为进行了规定,但是尽管如此,依然无法平息关于构成要件的争论。首先对学术界关于该制度构成要件的相关学说进行梳理,然后通过对比分析,提出自己关于共同危险行为构成要件的理解。

| Abstract: | Because of Joint Dangerous Act has been paid much attention in the academic and practical field,people have different opinions on the theory of its constructive requirements.With the implemented of the Tort Law of China,the discussion about the constructive requirements of the joint dangerous act has been made.The essay analyzed the theories of different scholars about the constructive requirements of the joint dangerous ac and gave its own interpretation of the the constructive requirements of the joint dangerous ac. |
