| 摘 要： | 最高人民法院和最高人民检察院作出的司法解释在我国法律实务中，尤其是在司法判决的过程当中起到了十分重要的作用，对于指导法律的实施、统一全国法律适用的标准、弥补法律漏洞有不容忽视的指导意义。然而，一个尴尬的局面是，虽然司法解释对于我国司法实务的作用十分突出，但是最高法和最高检司法解释权的法律依据却仍然不明晰。许多司法解释一定程度上替代了立法甚至改变了立法的规定，使得我们不得不思考“两高”在作出司法解释时在解释范围和解释程度方面所应当遵守的限制。

| Abstract: | The judicial interpretations made by the Supreme People＇s Court and the Supreme People＇s Procuratorate have played a very important role in guiding the implementation of law and the process of judicial decisions, and also it helps to unify the national standard of law application, which is of great importance in making up the loopholes in the law. However, an embarrassing situation is that, although the role of judicial interpretation in the judicial practice is very prominent, the legal basis of the authority of judicial interpretation remains unclear. Meanwhile, many judicial interpretations even changed the legislation, which leads us to think about restrictions of the scope and degree of the judicial interpretation that the Supreme People＇s Court and the Supreme People＇s Procuratorate should abide by. |
