| 摘 要： | 知识是一种标准的经济产品，其所有权可以进行明确的分配。但是，知识实际上是一种公共产品，这意味着它具有非竞争性和非排他性。在TRIPS协定中，要求所有全球经济体制中的国家都遵守始终如一的知识产权制度。从理论上讲。在国家层次和国际层次上，都不能运用始终如一的专利权保护的最低标准。

| Abstract: | The basic definition of patents tends to imply that knowledge is a standard economic good to which pmperty rights can be clearly assigned and enforced. Yet, it is widely known that knowledge is actually a public good, which means that it is non-competitive and non-excludable. TRIPS demands that all countries wishing to participate in the global economy must now adhere to one relatively uniform set of IPR, but there is therefore no basis for the demand for uniform minimum standards of patent pmtection at the national and international levels. |
