| 摘 要： | 在我国，科技成果申请专利保护的比例非常低，专利保护成本高是其重要原因之一。为此，本文首先分析了专利保护成本的构成，列举出个体直接成本和机会成本及其影响因素；其次，分析了专利侵权成本的构成，认为其主要包括侵权产品的生产成本和因侵权被发现后所要承担的经济负担；最后，从降低专利保护成本、增大专利侵权成本的角度提出了完善专利保护的１１条建议。

| Abstract: | The radio of scientific and technological achievements applying for patent was very low in China. One of the reasons is high cost of patent pvotection. Herein, this paper discussed the cost compositions of patent protection and cited the factors affecting individual indirect cost and individual chance cost; then analysed the cost compositions of patent infringement and it was believed that they mainly included production cost of infringement products and economic load due to infringement found; Finally, 11 suggestions improving patent protection were set according to lowering the cost of patent protection and increasing the cost of patent infringement. |
