| 摘 要： | 腐败滋生蔓延是社会经济体制、政治体制各种因素综合作用所致.在我国,腐败者所付出的成本低是腐败滋生的原因之一.在现有体制下,与其所实施的腐败行为相比,腐败者在经济上、政治上、承担刑事责任以及所承担的精神压力等方面投入的成本较小.本文通过对腐败成本的分析,针对我国腐败行为的“低风险、低成本、高收益”的现状,提出以刑事法律提高腐败成本的方式,从而加大对腐败的惩治力度,构筑反腐防线.

| Abstract: | Breeding and spreading of corruption due to various factors of socio-economic system,and political system.In China,low cost pay of corruption is one of the reasons of its widespread.Under the current system,compared with their implementation of corruption,the corrupters’cost of inputs in the economic,political,criminal responsibility and the mental stress committed so on are lower.Based on the analysis of the cost of corruption,the paper proposes to improve the cost of corruption with the way of criminal law in view of the"low-risk,low-cost,high-yield"of the corruption in the present situation of China,in order to increase the intensity of the punishment of corruption and build the defense against corruption. |
