| 摘 要： | 阐述环境侵权不同于传统的民事侵权,针对现行司法实践中一般只对能够确定的人身、财产损害予以民事侵权赔偿,且环境侵权双方当事人地位的不平等迫使一部分受害者放弃了法律救济的途径等问题。提出在环境侵权中应引入惩罚性赔偿制度,以求为环境侵权救济寻求一条更加畅通的路径的建议。

| Abstract: | Environment infringement is notably different from traditional civil infringement. In the present judicial practice only the confirmed harm of fights of person and property is compensated. Additionally because of the inequality of both parties in the environment infringement some victims have to give up the way of law relief. In order to solve this problem, this text attempts to introduce the punishing compensation system in the environment infringement, trying to seek a more unblocked route for the environment infringement relief. |
