| 摘 要： | 政府资助科技项目涉及的权利主体众多且利益动机各异,难免存在不同程度的利益冲突,因此对有关权益主体进行合理的知识产权利益配置就显得尤为迫切。由于我国在此领域的法律存在彼此冲突、甚至是法律空白的现象,致使相关权利主体之间在发生利益冲突时存在着法律适用困难,以致最终影响到相关法律的目标实现。为有效鼓励科技创新,促进科技成果转化,尤其需要完善职务发明人权益的保障机制以及合作研发单位之间的利益分配机制,以实现各方权利主体利益的合理平衡。

| Abstract: | The government-funding projects involve many subjects whose interests and motivation are all different,which result in varying degrees of interest conflict inevitably.So it is urgent to deploy the relevant intellectual property rights and interests reasonably.Because the phenomenon of conflicts among different laws and even legal gaps in this domain,which result in difficulties in application of law in the event of a conflict of interests and ultimately affect the achievement of objectives related to the law.In order to effectively encourage technological innovation,promote the transformation of scientific and technological achievements,improving the investors protection and benefits distribution mechanisms among cooperative R D units are needed in particular to achieve interest balance. |
