| 摘 要： | 新刑法对于正当防卫的成立范围较之旧刑法更为广泛,应当认真认定正当防卫的存在范围。新刑法对于防卫过当的成立作出了严格的限定,有利于弘扬社会正气。新刑法并未增设特别防卫权,所谓的特别防卫权属于正当防卫的当然内容。

| Abstract: | The establishment of a new range of criminal defense is more extensive than the old criminal law, there should be carefully identified the scope of legitimate defense. The establishment of new criminal law for over-defense to a strict limit, help foster healthy social trends. The new Penal Code does not set up special defense right. |
