| 摘 要： | 学生伤害事故学校是否承担法律责任，现实中家长、学校的做法经常是片面的，甚至是偏激的．致使问题不能很好解决，反而常常使矛盾激化。正确的解决途径应该在明确学校与学生之间法律关系的基础上，依据不同的归责原则作具体分析，且不能以简单的时空论之。

| Abstract: | In practice, the viewpoints of the parents and school are often lopsided, even extreme on the issue of whether or not the school should bear the legal liability for the students' injuries. Therefore, the problem usually can't be solved smoothly. On the contrary, the contradiction is often intensified. It is a right way that the specific analysis is placed on the base of the clear and definite legal relations between the school and their students, and is made according to the legal responsibility they should take respectively. Therein, the inference can't be drawn from the oversimplified time and space relations. |
