| 摘 要： | 法治资源问题的探讨,必然需要以人作为评价主体进行价值判断,由是形成法的价值位阶的争论。价值位阶的讨论旨在权衡各种价值之高低,进而作取舍。此过程中,一些分配理念被触及,由此产生公平与效率何者优先的争论。以此两对价值的冲突大略可窥知法治资源的取舍用殊,从而得法治资源体用之真意,破斥法治本土资源论者的诡辩。
