| 摘 要： | 在边疆民族地区离婚救济制度在保护弱者利益、促进社会和谐与稳定方面起到了积极作用，但也存在许多明显问题：“保护无过错方、惩戒过错方的制度”无法达到应有效果；家务劳动补偿制度无实施前提条件；获得的经济帮助极少等。借鉴世界各国的立法经验，应进一步完善离婚损害赔偿制度，重构离婚经济帮助制度，修改家务劳动补偿制度。

| Abstract: | The relief system of divorce in the border and minority areas plays an active role in protecting the rights of the weak group of people and maintaining social stability,but there still exist many obvious problems such as the legislation aim" to protect the legal interest of non-faulty party of marriage and punish the faulty one" not fully realized;the lack of pre-condition of the implementation of housework compensation;the shortage of economic aid.Importance should be attached to further perfecting the system of divorce damage compensation,restructuring the system of economic aid in divorce,and amend the housework compensation by learning the legislation experience from other countries of the world. |
