| 摘 要： | "构建和谐社会"是我国当前社会发展的主题,各项制度的建立与实施均应符合这一主题的需要.我国土地征收制度从制度设计到具体实施都存在许多问题,主要表现为对"公共利益"的限定不明确;土地征收程序过于简单,缺乏规范性;补偿机制不够完善等,严重损害了被征地农民的合法权益,影响社会的稳定和和谐社会的构建.应从公益目的的审批、严格全面的征收程序以及公正合理的补偿机制等方面对我国土地征收制度予以完善.

| Abstract: | At present building a harmony society is one of the main concerns of our government.Every policy taken and law made should serve this purpose.However,the defects lie in the pesent policy about land requisition,both in the legislation and in its enforcement,and run against the aim of buliding a stable and harmony society.They involve the vague definition of public benefit and too simple procedure in making a requisition of land,as well as lack of regulation,and shortcomings in compensation policy.The law of land requisition should be amended to make the examination and approval of land requisition serve pubic benefit and to have strict procedure of requisition and fair and rational compensation for the requisitioned land. |
