| 摘 要： | 从契约文本和民间契约习惯来看，清代的买卖契约存在内容上重视卖方而忽视买方和重要内容缺省的显著特点，这和现代民法的相关规定及实践明显不同。但这并不能否定清代的契约主体之间在经济关系上的平等性。买卖契约内容的“片面性”及其重要内容的缺省是由清代契约功能的“过去性”指向所决定的，同时也可以说是买卖契约订立双方为减少和规避国家税收而“合谋”的结果。

| Abstract: | From the sale-memorandum and the customs,the content of the sale-contract focused on the information of the seller while neglecting the buyer's and sometimes deficient in important factors of a complete contract.It is obviously different from the modern civil law.However,it could not deny the equality of the partners' on economy in Qing Dynasty.The unbalance and its deficiency of the sale-contract were determined by the function of the contract,as a proof of the passed sale.On the other hand,those characteristics came out when the partners tried to conspire to evade the taxations. |
