| 摘 要： | 现行法律对于商标使用权能否出资尚无明确规定,商标使用权出资有现实需求且具有必要性,在理论和实践中都有重要意义。商标使用权出资符合知识产权出资的标的要求,与商标所有权出资以及商标许可使用相比,具有很大优势,与现行法律规定也不相悖,应该在法律法规上对商标使用权出资加以明确规定。

| Abstract: | It is not clear whether trademark use rights can be invested according to the existing laws. There is a realistic demand and necessity of investment in trademark use rights. Being of theoretical and practical significance, the investment conforms to the requirements of intellectual property investment subject. Compared with trademark ownership investment and trademark license, it has advantages and is not contradictory to the existing laws and regulations. Investment in trademark use rights should be defined clearly in laws and regulations. |
