| 摘 要： | 罪刑法定原则是现代刑法的一项基础性原则,也是现代刑法人权保障价值的集中体现.罪刑法定原则如何在一系列的价值理念和机能相冲突的情况下寻求一种平衡,直接关系到这一原则的发展与刑法功能的发挥.因此,司法人员正确理解罪刑法定原则的历史价值,从社会发展的需要赋予它新的历史涵义,才能使这一原则得以继续坚持与发扬,捍卫刑法基本的价值与功能.

| Abstract: | The principle of legality is one of the basic principles in modern crime law and reflect the value of protecting human right.How to find the balance between different values directly affects the development of this principle and the function of crime law.Only the one with mastering the history value of principle of legality and endowed with new meaning can hold this principle in crime law,definitely,and it is also very important for the values and function of crime law. |
